Terms of Service

1. Parties
This agreement is entered into between the GeckoAuthority platform (hereinafter referred to as the "Platform") and the user registering on the platform (hereinafter referred to as the "Member"). The Platform operates under the laws of the Republic of Turkey.
2. Subject of Agreement
This agreement governs the terms and conditions for the Member to use artificial intelligence-powered content generation services offered through the Platform, and the rights and obligations of the parties.
3. Membership Conditions
To become a member:
- Must be over 18 years of age or have legal guardian consent
- A valid and accessible email address is required
- Accurate, current, and complete information must be provided during registration
- Each user may create only one account; multiple account usage is prohibited
4. Member Obligations
The Member accepts and undertakes the following obligations:
- To maintain the confidentiality of account information and access credentials
- Not to use the Platform for illegal, harmful, or rights-infringing purposes
- Not to create harmful, misleading, defamatory, or libelous content
- Not to engage in actions that may harm the Platform's technical infrastructure, security systems, or other users
- To respect copyright, trademark, and other intellectual property rights
5. Prohibited Use
Use of the Platform for the following purposes is strictly prohibited:
- Creating deepfakes, manipulated media, or fake identity content
- Producing disinformation, fake news, or intentionally misleading content
- Spreading hate speech, discrimination, incitement to violence, or terrorist propaganda
- Creating content that encourages illegal activities or leads to criminal acts
- Producing content that infringes copyright, patent, or trademark rights
- Using for spam, phishing, or malicious software distribution
When violation of these terms is detected, the Member's account will be immediately and permanently terminated without any refund. The Platform reserves the right to initiate legal proceedings when necessary.
6. Platform Obligations
The Platform undertakes the following obligations:
- To ensure reasonable sustainability and accessibility of services
- To protect Member data privacy and security at industry standards
- To provide technical support and user assistance
- To guarantee the usability of purchased credits within the platform
- To inform Members of service changes with reasonable advance notice
7. Third-Party Services
The Platform uses the following third-party service providers to deliver its services:
- OpenAI (GPT-4, DALL-E): Text and image generation
- ElevenLabs: Audio content generation
- Pexels: Stock image and video source
- Google APIs: Search and indexing services
- Stripe: Payment processing infrastructure
These service providers' own terms of use and privacy policies apply. The Platform cannot be held responsible for disruptions caused by interruptions, changes, or service terminations in third-party services. Third-party service terms constitute an integral part of this agreement.
8. Credit and Payment Terms
Rules regarding the credit system:
- Credits are purchased on a prepaid basis. They are divided into two types: 'Normal Credit' (Writing) and 'Premium Media Credit' (Media).
- Credits purchased by the user through payment have no expiration date.
- Credits cannot be transferred to other accounts or converted into cash.
- Credits provided free of charge or as promotional credits on a monthly basis under LTD (Lifetime Deal) packages or within campaigns are reset at the end of the period they are granted (on the next reload date). Unused monthly credits do not carry over to the following month.
- All prices are determined inclusive of VAT.
9. Refund Policy
Under Article 48 of the Consumer Protection Law No. 6502; in digital content sales, the right of withdrawal cannot be exercised once the content has been performed (used). Credits purchased on the Platform are digital content made available for immediate use. When credit usage is initiated or the content generation process is triggered, the service fee is non-refundable and the right of withdrawal expires.
Quality Guarantee: Free revision rights are granted for content found below quality standards by the Platform's AI Reviewer system. This guarantee replaces refund requests.
10. Content Ownership and Confidentiality
All intellectual property, usage, and commercial rights to the content produced through the platform belong exclusively to the Member.
Confidentiality Guarantee: The platform shall not share, showcase as examples, or use in its own marketing activities any content generated by the Member with third parties in any way without the Member’s explicit written consent. GeckoAuthority undertakes that it will not use Member data and generated content for the purpose of training artificial intelligence models.
11. Data Security and AI Training Policy
The Platform commits to protecting Member data security at the highest level:
- All data is protected with 256-bit SSL/TLS encryption
- User data is processed according to GDPR and local data protection standards
- Regular security audits and penetration tests are conducted
CRITICAL GUARANTEE: Raw data provided by Members, entered content, and generated outputs are NEVER USED to train, develop, or improve the artificial intelligence models of GeckoAuthority or any third-party service. Member data is processed only for delivering the requested service and is not used for any other purpose.
12. Limitation of Liability
The Platform's liability limits are determined as follows:

Not a Decision Support Mechanism: The Platform is not a decision support system, advisory service, or professional advice source. Generated content is for informational purposes and does not constitute medical, legal, financial, or professional advice. Relevant experts should always be consulted for decisions in these areas.
2. AI Hallucination
AI Hallucination Risk: Artificial intelligence systems may occasionally produce incorrect, incomplete, outdated, or out-of-context information. This is a known limitation inherent to AI technology. The Platform cannot be held responsible for AI-related data errors, misinformation, and any direct or indirect material/moral damages arising from their use.

Member Responsibility: Control of the accuracy, currency, and fitness for purpose of all generated content is the Member's responsibility. It is recommended to review content and make necessary corrections before publication.

Maximum Liability: The Platform's total liability for any reason cannot exceed the total amount paid by the Member to the Platform in the last 12 months.
13. Account Suspension and Termination
The Platform may suspend or permanently terminate an account without prior notice in the following situations:
- Violation of this agreement's terms or Platform rules
- Detection of fraud, forgery, or bad faith
- Suspicion of illegal activity or criminal conduct
- Violation of prohibited use clauses
- Creating multiple accounts or account sharing
- Attempted attacks on the Platform's technical infrastructure
The Member has the right to close their account at any time. When the account is closed, unused credits are not refunded and data is processed according to the Platform's data retention policy.
14. GDPR and Data Protection Compliance
The Platform operates in full compliance with the European Union General Data Protection Regulation (GDPR) and Turkey's Personal Data Protection Law (KVKK).
Member's rights under GDPR:
- Right to access and obtain a copy of personal data
- Right to request correction of incorrect data
- Right to request deletion of data (right to be forgotten)
- Right to request restriction of data processing
- Right to data portability
- Right to object to automated decision-making and profiling

15. Dispute Resolution and Jurisdiction
Turkey Operations: Istanbul Courts and Enforcement Offices have jurisdiction over disputes arising from this agreement. Laws of the Republic of Turkey apply.
International Operations: For users accessing from outside Turkey, the laws of the Republic of Estonia apply and Tallinn Courts have jurisdiction. This clause does not eliminate local consumer protection rights.
The parties agree to prioritize amicable negotiation in resolving disputes.
16. Contract Changes
The Platform reserves the right to modify this agreement with prior notice. Significant changes will be notified by email at least 30 days in advance. Changes take effect from the date of publication. Members who do not accept changes have the right to close their account.
17. Effectivity
This agreement enters into force upon the Member's approval of the registration form and activation of the account. The agreement remains valid until termination by either party, account closure, or Platform service termination.
